Terms of Use

By creating an account or using the App you agree to these Terms. If you do not agree, please do not use PicsOfMe. Please also read our Privacy Policy, which explains how we handle your data, including biometric data.

1. About PicsOfMe

PicsOfMe is a mobile application operated by PicsOfMe Limited, a company registered in England and Wales ("PicsOfMe", "we", "us", "our"). The App allows photos taken at events to be automatically matched to, and shared with, the people who appear in them, using facial recognition technology.

These Terms of Use ("Terms") govern your access to and use of the PicsOfMe mobile application, any associated website, and all related features and services (together, the "Service"). They form a legally binding agreement between you and PicsOfMe Limited.

2. Who Can Use PicsOfMe

2.1 Age requirement

You must be at least 13 years old to create an account and use the Service. If you are between 13 and 18, you may only use the Service with the consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. We do not knowingly process the biometric data of children under 13.

2.2 Capacity

By using the Service, you represent that you have the legal capacity to enter into these Terms in your jurisdiction, or that you have obtained the necessary parental or guardian consent.

3. Your Account

3.1 Registration

To use most features of the Service, you must create an account with accurate and complete information. You agree to keep your account information up to date.

3.2 Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you suspect unauthorised access, you must notify us immediately.

3.3 One person, one account

Each account is personal to you. You may not transfer, share, sell or assign your account to another person, or create multiple accounts for the same individual.

4. Facial Recognition and Your Consent

4.1 How it works

PicsOfMe uses facial recognition to match photos taken at events with the people who appear in them. When you opt in, we create a facial recognition template ("faceprint") — a mathematical representation of the geometry of your face — from a reference selfie or profile photo you provide. This template is compared against faces detected in event photos, and when there is a match, those photos are delivered to you.

4.2 Biometric data requires your explicit consent

Your faceprint is biometric data, a special category of personal data. We will only create and use it if you give us separate, explicit consent within the App. Your consent covers matching across all events you participate in — you do not need to re-consent for each new event. This consent is entirely voluntary — you are not required to enable facial recognition to use the Service, and where possible, we will provide alternative ways to access event photos (for example, browsing an event album manually).

4.3 Withdrawing consent

You can withdraw your consent at any time through the App's settings. When you do, we stop matching you and delete your faceprint within 30 days. Full details, including what happens to photos you appear in, are set out in our Privacy Policy (Sections 6 and 17).

4.4 Accuracy

Facial recognition is not infallible. We do not guarantee that every match will be correct or that every photo of you will be found. You should not rely on PicsOfMe as your sole or definitive record of an event.

5. How the Service Works

5.1 Events and albums

The Service is organised around events. An event organiser or photographer may create an event on PicsOfMe and upload photos. Attendees who join the event can receive photos they appear in (if they have opted into facial recognition) or browse the event album (where the organiser permits).

5.2 Joining events

You can join an event using a code, link or invitation provided by the organiser. Access to an event and its photos is governed by the settings chosen by the organiser.

5.3 Viewing, downloading and sharing

When you are matched to a photo, or when you access an event album, you may view, download and share those photos, subject to any restrictions set by the event organiser and to these Terms. Event album photos remain available to participants for as long as the Service is in operation. We may in the future introduce a retention period, after which event photos are removed; if we do, we will give you reasonable advance notice and the opportunity to download any photos you wish to keep. Sharing photos outside the App is your responsibility — please respect the privacy of other people who appear in the photos.

6. Your Content

6.1 What "Your Content" means

"Your Content" includes any photos, images, text, profile information or other material that you upload, submit, post or otherwise make available through the Service, including your reference selfie.

6.2 Ownership

You retain ownership of Your Content. By uploading it, you do not transfer ownership to us.

6.3 Licence you grant us

By uploading Your Content, you grant PicsOfMe a worldwide, non-exclusive, royalty-free, sub-licensable licence to use, host, store, reproduce, process, adapt and display Your Content solely for the purpose of operating, providing and improving the Service. For your reference selfie and faceprint, this licence is limited to performing facial recognition matching, applies across all events you participate in, and is subject to your consent (Section 4). This licence terminates when you delete Your Content or your account (with faceprint deletion completed within 30 days), subject to reasonable backup cycles and any legal retention obligations.

6.4 Your responsibilities

You represent and warrant that:

  • you own Your Content or have all necessary rights and permissions to upload and share it;
  • Your Content does not infringe the intellectual property rights, privacy rights or any other rights of any third party;
  • where Your Content includes photos of other identifiable people, you have a reasonable basis for sharing those images and have not been asked by those individuals to refrain from doing so; and
  • Your Content complies with the Acceptable Use rules in Section 7.

6.5 Our right to remove content

We may, but are not obligated to, review, moderate or remove any content on the Service. We may remove or restrict access to Your Content if we reasonably believe it violates these Terms, infringes third-party rights, or is otherwise harmful, without prior notice.

7. Acceptable Use

You agree not to use the Service to:

  • upload, distribute or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, sexually explicit, or that depicts the exploitation or abuse of minors;
  • upload photos of people without a reasonable basis, or deliberately upload photos intended to harass, stalk, intimidate or embarrass others;
  • impersonate any person or entity, or misrepresent your identity or affiliation;
  • use the facial recognition feature, faceprints or any data from the Service to identify, profile, track or surveil individuals without their knowledge and consent;
  • scrape, harvest, crawl, or collect data from the Service by any automated means, including facial recognition data, photos or user information;
  • reverse-engineer, decompile, disassemble or attempt to extract the source code or algorithms of the App;
  • circumvent, disable or interfere with security features, access controls, or usage restrictions of the Service;
  • use the Service for any purpose that violates applicable law or regulation;
  • use the Service to send unsolicited messages, advertising or spam;
  • introduce malware, viruses or any other harmful code; or
  • assist, encourage or enable any other person to do any of the above.

We reserve the right to investigate and take appropriate action, including suspending or terminating your account, for any violation of these rules.

8. Event Organisers and Photographers

8.1 Additional responsibilities

If you use PicsOfMe as an event organiser or photographer, you have additional responsibilities beyond those of a regular user:

  • You are responsible for ensuring that your photography and use of the Service at the event complies with applicable law, including data protection and privacy law.
  • You must ensure that event attendees are adequately informed that photos taken at the event will be uploaded to PicsOfMe and processed using facial recognition, for example through visible signage, a written notice in the event registration, or verbal announcements.
  • You must not upload photos of events or gatherings where attendees have a reasonable expectation that photos will not be taken or shared (unless you have obtained appropriate consent).
  • You are responsible for ensuring that any photos of children or minors are uploaded with an appropriate legal basis, such as parental or guardian consent.

8.2 Organiser agreement

We may require event organisers to accept supplementary terms or sign an event data-sharing agreement before using the Service for their event. These supplementary terms will be provided separately where applicable.

9. Intellectual Property

9.1 Our rights

The Service, including all software, design, text, graphics, logos, icons and the underlying technology (but excluding Your Content), is owned by or licensed to PicsOfMe Limited and is protected by copyright, trademark and other intellectual property laws. Nothing in these Terms transfers any ownership of the Service to you.

9.2 Limited licence to you

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service on your personal device for your personal, non-commercial use, in accordance with these Terms. This licence does not include any right to sub-license, sell, resell, copy, modify, distribute or publicly display any part of the Service.

9.3 Feedback

If you provide us with suggestions, ideas or feedback about the Service, you agree that we may use them without restriction or compensation to you.

10. Third-Party Services

The Service may contain links to, or integrations with, third-party services (for example, cloud storage or social media platforms). We do not control and are not responsible for those services or their privacy practices. Your use of third-party services is governed by their own terms and policies.

11. Availability and Changes to the Service

11.1 No guarantee of availability

We aim to make the Service available at all times, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

11.2 Changes

We may modify, update, suspend or discontinue any part of the Service at any time. Where a change materially reduces the functionality you rely on, we will make reasonable efforts to notify you in advance. If you do not agree with a material change, your remedy is to stop using the Service and close your account.

12. Fees and Payments

PicsOfMe is currently offered free of charge to individual users. If we introduce paid features, subscriptions or other charges in the future, we will notify you before those charges apply, and you will have the choice to accept or decline.

Event organisers or photographers may be subject to separate pricing terms, which will be presented before use.

13. Disclaimers and Limitations of Liability

13.1 The Service is provided "as is"

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13.2 No guarantee of accuracy

We do not warrant that facial recognition matches will be accurate, complete or error-free. A match does not guarantee identity, and a missed match does not mean you were not present. You should not rely on the Service as evidence of presence or absence at an event.

13.3 Limitation of liability

To the maximum extent permitted by applicable law:

  • PicsOfMe Limited, its directors, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or opportunity, arising out of or in connection with your use of the Service, however caused and under any theory of liability.
  • Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts you have paid us, if any, in the twelve (12) months preceding the claim, or (b) £100.

13.4 Statutory rights

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded. If you are a consumer in the UK or EEA, these Terms do not affect your statutory consumer rights.

14. Indemnification

You agree to indemnify, defend and hold harmless PicsOfMe Limited, its directors, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your Content, including any claim that it infringes third-party rights;
  • your breach of these Terms or of applicable law;
  • your use of the Service in a manner not authorised by these Terms; or
  • your violation of the rights of another person, including privacy rights.

This indemnification obligation applies to the fullest extent permitted by applicable law and survives termination of your account.

15. Suspension and Termination

15.1 By us

We may suspend or terminate your access to the Service, in whole or in part, at any time and without prior notice if:

  • you breach these Terms or the Acceptable Use rules;
  • we are required to do so by law or a regulatory authority;
  • your conduct creates risk or legal exposure for us, other users, or third parties; or
  • your account has been inactive for an extended period.

Where practicable, we will notify you of the reason for suspension or termination. Suspension or termination does not relieve you of any obligations accrued before that date.

15.2 Effect of termination

Upon termination of your account, your right to use the Service ceases immediately. We will handle your data, including deletion of your faceprint, in accordance with our Privacy Policy (Section 17). Provisions that by their nature should survive termination (including Sections 6.3, 9, 13, 14, 17 and 18) will continue to apply.

16. Your Right to Close Your Account

You can close your account and stop using the Service at any time. The App provides options to:

  • Stop face matching only — we delete your faceprint within 30 days while keeping your account active.
  • Delete your account — we close your account and delete associated personal data.
  • Erase all your data — full erasure, subject to limited legal retention exceptions.

Full details of what each option involves, including how we handle photos you appear in, are set out in our Privacy Policy (Section 17).

17. Dispute Resolution

17.1 Governing law

These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.

17.2 Jurisdiction

You and PicsOfMe agree to submit to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer resident in another part of the United Kingdom, you may bring proceedings in the courts of your place of residence, and nothing in these Terms affects your right as a consumer to bring proceedings in any court of competent jurisdiction.

17.3 Informal resolution

Before initiating any formal proceedings, we encourage you to contact us first so we can try to resolve the issue directly. Many concerns can be addressed quickly through our complaints process (see our Privacy Policy, Section 18).

18. General Provisions

18.1 Entire agreement

These Terms, together with our Privacy Policy and any supplementary terms we present to you, constitute the entire agreement between you and PicsOfMe Limited regarding your use of the Service, and supersede all prior agreements and understandings.

18.2 Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions will continue in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, reorganisation or sale of assets, provided that such assignment does not reduce your rights under these Terms.

18.5 No third-party beneficiaries

These Terms do not create any rights for any third party. Nothing in these Terms is intended to be enforceable by any person who is not a party to them, pursuant to the Contracts (Rights of Third Parties) Act 1999.

18.6 Notices

We may send you notices through the App, by push notification, by email to the address associated with your account, or by post. You may send notices to us at the contact details in Section 20.

19. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email before the changes take effect and give you the opportunity to review them. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of them. If you do not agree to the updated Terms, you must stop using the Service and close your account.
